Understanding the Work History Report

One of the forms the SSA will have you complete during the disability process is the Work History Report. (a.k.a. Form SSA-3369-BK) This form is very important for all disability claims. At Step 4 of the 5 step analysis, the SSA will determine if you can still do any “past relevant work”. (See our post about past relevant work for more information.) In order for them to make this determination, they need to know what work you did. This form is the perfect opportunity to do just that!
There are several important things to keep in mind when completing the Work History Report. The most important thing to remember is to tell the truth. The SSA needs to know about all work you have done and jobs you have had, generally within the last 5 years. This includes all self employment and “under the table” jobs, even if you didn’t pay taxes.
You also need to pay close attention to Section 2. The beginning of Section 2 wants you to break down how many hours of each day you were walking, standing, and sitting. These hours must add up to the total number of hours you worked per day. For example, in an 8 hour workday, a person might walk for 1 hour, stand for 2 hours, and sit for 5 hours; which adds up to 8 hours. They do not want you to say that you were expected to walk for 8 hours, stand for 8 hours, and sit for 8 hours. Your job may have required you to be flexible, but you cannot walk and sit at the same time. We have seen the SSA return many Work History Reports because these numbers did not add up.
Also, this form is usually time sensitive, so be sure to complete the Work History Report and return it to the SSA within the time period specified. If you need more time, you may be able to ask for an extension.
