Car Accident - Can I qualify for Disability?

Every year thousands of Americans are injured in car accidents. Many of these injuries are serious enough to impact your work activity. The injuries may even require you to stop working for a time. Because of this impact on your ability to work, you may be wondering if you qualify for Social Security Disability (SSD). 


The answer to that question is similar to most legal questions: it depends. It depends because one of the most important SSD issues for a car accident injury is the one year requirement. The SSA requires that “Unless your impairment is expected to result in death, it must have lasted or must be expected to last for a continuous period of at least 12 months.” (C.F.R. § 404.1509.) So, unless your injury will continue to be severe for at least a year, you would not qualify for SSD.
